Conditions of use of my works

Intent

Most of my photography and video works are shared for free and cost a lot of time and money. You may think that getting and using a photo from time to time doesn't cost much, but after summing all the micro costs, it is often too demanding to be considered as only voluntary work.
However I want the "spontaneous" and "social" parts to remain something I share for free.

Additionally

If I have the occasion to make profit out of some work that involves you, I will first contact you.
My publishings on social network already brings a free promotion for all kind of events.

That is the part I bring in.

What I expect from you is

If you use my works to make profit, directly or indirectly, I deserve a share of that profit. If I have the occasion to make profit out of some work that involves you, I will first contact you.
For private use, do not cut the copyrights. If, for technical reason, you cannot do otherwise (for example: for profile photos on social networks), then keep somewhere a reference to my copyrights/web site as explained further on this page.

Short legal reminders

Photos belong to the photographer, which means the person who pressed the button. That is called copyright. Unlike what is often believed, photos do not belong to people appearing on them, but those people can have their word to say about use being made of their image. That is called image right.
The fact that works are available online does not remove copyright.

These conditions are not only for my photos but also for my videos and other types of works.

For professional use

If you wish to use my works in order to make direct or indirect profit, to create value, or for any professional, semi-professional, commercial or promotional use¹, ask me for conditions and authorisation giving as much detail as possible about the desired use².³

For private use

For private use, do not cut the copyrights. If, for technical reason, you cannot do otherwise (for example: for profile photos on social networks), then keep somewhere a reference to my copyrights/web site as explained further on this page.
If you are not sure what category your desired use belongs to, contact me giving as much detail as possible about the desired use².

How to mention my credits/copyrights

For tango works: for example, "Photo: http://thomasconte.net/tango/". The most important part is "http://thomasconte.net/tango/".
For other/generic works: for example, "Photo: http://thomasconte.net/photography/". The most important part is "http://thomasconte.net/photography/".
If on Facebook, additionally tag my Facebook page (not my profile)

Miscellaneous

If you are not sure what you can do, ask me. ²
You need to ask the models/photographee for the image use (unless I am allowed to transfer image right for some specific works).
If I have let you use some works for free or cheap, that doesn't mean that the next ones should be at the same price. Please ask again.
The fact that you appear in work doesn't allow you to bypass copyright.
I wrote this already but as it isn't clear for some, I wrote it again: I'm not selling your image right. If necessary, I'll contact you or a potential user will contact you.

The persons or organisations of the following list as well as works including them, may not benefit of any form of exception or free private usage. Full price payment is required. This is most likely because they showed highly dishonest behaviour and cannot be trusted:

Compensations

Please note that it is not because you have removed a work after stealing it that you haven't stolen it.

Reproduction without my agreement	200% of the price I would have asked with a minimum of 123,95 EUR.
Reproduction without credits	300% of the price I would have asked to remove the signature with a minimum of 247,89 EUR.
Reproduction with a false signature	500% of the price I would have asked to remove the signature with a minimum of 619,75 EUR
Reproduction with unauthorised tranformation(s) without my agreement	200% of the price I would have asked with a minimum of 123,95 EUR.
Reproduction without models/photographees consent	This you have to see with the models/photographees. (Please don't insult them.)

¹ Being poor or "unprofessional" or pretentding to be a friend does not exclude your activity from the "professional" category. Sorry about that.

³ Exception: As it is there that I have started photography, tango organisers may use my works shot at their events or portraying themselves that I have already uploaded to Facebook as "Facebook events" covers (not print!) at condition that they do not omit to mention copyrights as details in these conditions and do not upload it to Facebook if it is not already on Facebook!

Additional notes

Don't donations and free entrances do compensate for the work?
- I do not expect donations to ever compensate the work and material investment, but I can take them into account.
- Free entrances, drinks and sometimes food do not compensate the work and material investment, but I can take them into account to some extent. But to be honest the equate to peanuts.
- Compliments, even if they are always nice to receive, do not compensate anything, at all!
